Social Security Survivor Benefits for Spouse

A surviving spouse is entitled to social security disability benefits on the injured worker’s earning record if the following requirements are met:

1.  The deceased worker must have been receiving Social Security Disability or Retirement benefits at the time of their death;

2.  They must have been married for at least one year; and

3.  The surviving spouse is at least 60 years old or the surviving spouse is disabled and between the age of 50 and 60.

If a spouse does not meet the above requirements they may still get benefits if they are eligible for Mother’s/Father’s Benefits.

Spousal Survival Benefits will end if he/she remarries or becomes eligible to receive significantly higher benefits based on their own earning record.
